In <em>Akaya<\/em>, the Applicant\u2019s study permit was refused with the IRCC officer finding that the Applicant did not have sufficient available finances for their studies.<\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p id=\"viewer-9p2rl4511\" class=\"-Q4aO hw1z8 hD2az o-zp-\" dir=\"auto\"><span class=\"ATqq4 hD2az\">In particular, the officer refused the application, in part, because the financial documents provided showed that funds were held by the Applicant\u2019s brother but that <em>a family link could not be established between the applicant and their brother<\/em>.<\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p id=\"viewer-txk7d2223\" class=\"-Q4aO hw1z8 hD2az o-zp-\" dir=\"auto\"><span class=\"ATqq4 hD2az\">In the study permit application the Applicant clearly stated who their brother was, providing photos and a signed letter attesting to this. However, as indicated in the officer\u2019s processing notes, the IRCC officer found this insufficient to establish their blood relationship, refusing the application accordingly.<\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p id=\"viewer-47s5k2225\" class=\"-Q4aO hw1z8 hD2az o-zp-\" dir=\"auto\"><span class=\"ATqq4 hD2az\">Upon Judicial Review, the Honourable Justice Tsimberis, in reviewing the decision, found that the decision was <em>unreasonable<\/em> as the Applicant was denied the opportunity to respond to IRCC\u2019s concerns about the family relationship after providing their documents:<\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p id=\"viewer-sonar2229\" class=\"-Q4aO hw1z8 hD2az Mp7EQ\" dir=\"auto\"><span class=\"ATqq4 hD2az\">\u201cthe Officer was nonetheless required to provide Ms. Akaya with an opportunity to respond to the Officer\u2019s concern <u>as to the authenticity of the documents and information<\/u> submitted in her study visa application concerning the family link\u2026\u201d<\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p id=\"viewer-r5j4f2702\" class=\"-Q4aO hw1z8 DcaPr o-zp-\" dir=\"auto\"><span class=\"ATqq4\">Justice Tsimberis found this to be a breach of procedural fairness, as the credibility concern related to a central element of her application.<\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<p id=\"viewer-locii2734\" class=\"-Q4aO hw1z8 DcaPr o-zp-\" dir=\"auto\"><span class=\"ATqq4\"><strong>If you\u2019ve received a refusal on your study permit application and are looking at next steps, challenging the decision at the Federal Court may be an option for you.<\/strong><\/span><\/p>\n<\/div>\n<div data-breakout=\"normal\">\n<ul>\n<li id=\"viewer-i6o6u2237\" class=\"-Q4aO hw1z8 DcaPr Mp7EQ\" dir=\"auto\"><span class=\"ATqq4\">It will be important to apply for the officer\u2019s processing notes, to understand if their decision was indeed unreasonable.
