Friedman, Canadian Immigration Lawyer.<\/p>\n<p><!--more--><\/p>\n<p class=\"p1\">Following <span class=\"s3\">Bill C-3&#8217;s elimination of the first-generation limit<\/span>, a number of people recognized as Canadian citizens by descent \u2014 many in the United States \u2014 have received IRCC letters questioning the documentation behind their proof-of-citizenship application and asking that their certificate be surrendered. A useful early analysis is <span class=\"s3\">Amandeep Hayer&#8217;s post<\/span>, <span class=\"s4\"><i>Bill<\/i><\/span><i> <\/i><span class=\"s4\"><i>C-3<\/i><\/span><i> <\/i><span class=\"s4\"><i>Suspension<\/i><\/span><i> <\/i><span class=\"s4\"><i>Letters<\/i><\/span><i> <\/i><span class=\"s4\"><i>\u2013<\/i><\/span><i> <\/i><span class=\"s4\"><i>What<\/i><\/span><i> <\/i><span class=\"s4\"><i>is<\/i><\/span><i> <\/i><span class=\"s4\"><i>this about? <\/i><\/span>Mr. Hayer, of Hayer Law in Vancouver, is an active CILA member; he wrote in his individual capacity and the views are his own.<\/p>\n<p class=\"p1\"><strong>What the letters <span class=\"s6\">say<\/span><\/strong><\/p>\n<p class=\"p7\">The recurring complaint is about <b>provenance, not certification<\/b>: that records came from third-party repositories such as Ancestry or FamilySearch rather than the authority responsible for them \u2014 civil registries, vital statistics agencies, or other authorized bodies \u2014 even though the digitized image is often identical because the archive contracted with those platforms. The letters do not use the word &#8220;certified&#8221;; that gloss is an inference, and the evidence is mixed (some recipients submitted certified records throughout and still received letters). As Mr. Hayer notes, IRCC&#8217;s checklist (CIT 0014) does not restrict applicants to vital-statistics records: it contemplates &#8220;evidence of efforts&#8221; to obtain documents and permits &#8220;any other evidence&#8221; of a parent&#8217;s citizenship.<\/p>\n<p class=\"p1\"><strong>The mechanism: two <span class=\"s2\">tracks<\/span><\/strong><\/p>\n<p class=\"p8\">Where citizenship is alleged to have been obtained by fraud, the formal <b>revocation<\/b><b> <\/b>regime applies \u2014 <span class=\"s3\">s.<\/span> <span class=\"s3\">10<\/span>\/<span class=\"s3\">s.<\/span> <span class=\"s3\">10.1<\/span> of the <span class=\"s4\"><i>Citizenship Act <\/i><\/span>\u2014 with a Federal Court route and significant due process. The surrender letters allege no fraud.<\/p>\n<p class=\"p10\">They instead invoke administrative <b>cancellation<\/b><b> <\/b>under <span class=\"s3\">s.<\/span> <span class=\"s3\">26<\/span> <span class=\"s3\">of<\/span> <span class=\"s3\">the<\/span> <span class=\"s3\">Citizenship<\/span> <span class=\"s3\">Regulations<\/span>, where the protections are thinner: the duty of fairness from <span class=\"s13\"><i>Baker<\/i><\/span><i> <\/i>and reasonableness review under <span class=\"s13\"><i>Vavilov<\/i><\/span>.<\/p>\n<p class=\"p1\">Read s. 26 carefully. Subsection (1) lets the Registrar <span class=\"s4\"><i>demand surrender <\/i><\/span>on a &#8220;reason to believe\u2026may not be entitled&#8221; standard. Only subsection (3) authorizes <span class=\"s4\"><i>cancellation<\/i><\/span>, and only once &#8220;the Minister has determined&#8221; non-entitlement; (4) requires return of the certificate if the Minister finds the person <span class=\"s4\"><i>is <\/i><\/span>entitled. A suspicion-stage demand is not a determination \u2014 and recipients remain citizens, holding validly issued certificates, until a s. 26(3) determination is made.<\/p>\n<p class=\"p1\"><strong>The<span class=\"s2\"> merits<\/span><\/strong><\/p>\n<p class=\"p8\">The Federal Court has held repeatedly that applicants may rely on IRCC&#8217;s published instructions. In <span class=\"s13\"><i>Thompson v. Canada<\/i><\/span><span class=\"s3\">, 2021 FC 914<\/span>, the Court said applicants should not need a law degree to understand the requirements; Mr. Hayer reports the principle was reaffirmed in <span class=\"s4\"><i>Somers-Edgar<\/i><\/span>, 2026 FC 417. An applicant who submitted alternative evidence expressly contemplated by CIT 0014 has a strong argument that the certificate was not &#8220;issued in error.&#8221;<\/p>\n<p class=\"p1\"><strong>Recourse and the deadline<span class=\"s6\"> trap<\/span><\/strong><\/p>\n<p class=\"p8\">Once the certificate has issued and the oath is taken, the citizenship judge&#8217;s decision is spent; the matter does not return to a citizenship judge. Recourse is <b>judicial review<\/b><b> <\/b>in the Federal Court \u2014 and the timeline is a trap for immigration practitioners. Citizenship matters run on a flat <b>30-day<\/b><b> <\/b>leave-and-JR clock under <span class=\"s3\">s.<\/span><\/p>\n<p class=\"p1\"><span class=\"s3\">22.1 of the <\/span><span class=\"s13\"><i>Citizenship Act<\/i><\/span>, whether the person is in Canada or abroad. That is <span class=\"s4\"><i>not <\/i><\/span>the IRPA <span class=\"s3\">s.<\/span> <span class=\"s3\">72<\/span> 15-day\/60-day split \u2014 so a US-resident client does not get 60 days. Docket every letter against 30 days and request written reasons promptly.<\/p>\n<p class=\"p1\"><strong>Build the record<span class=\"s6\"> now<\/span><\/strong><\/p>\n<ul class=\"ul1\">\n<li class=\"li7\"><b>Keep<\/b><b> <\/b><b>a<\/b><b> <\/b><b>diligence<\/b><b> <\/b><b>log<\/b><b> <\/b>\u2014 dated record of every records request, response, and dead end.<\/li>\n<li class=\"li4\"><b>Memorialize why secondary evidence was necessary<\/b>, contemporaneously: e.g., Quebec relied on parish records until 1926; New<\/li>\n<\/ul>\n<p class=\"p13\">Brunswick did not register births until 1888; early civil registration was demonstrably incomplete.<\/p>\n<ul class=\"ul1\">\n<li class=\"li4\"><b>Document provenance <\/b>\u2014 where an archive contracted with Ancestry\/FamilySearch, and obtain the record directly from the government source where possible.<\/li>\n<li class=\"li4\"><b>Get the &#8220;no record&#8221; confirmation<\/b>, and if the agency refuses to issue one, keep that refusal as proof of diligence.<\/li>\n<\/ul>\n<p class=\"p4\"><strong>Why it hurts \u2014 and the statelessness <span class=\"s6\">risk<\/span><\/strong><\/p>\n<p class=\"p8\">People made life decisions in reliance on a status Canada granted: passports, jobs, homes, school enrolments, relocations. A letter that names no document and sets no clear cure leaves families unable to plan, and uneven results \u2014 one member questioned, a minor child not \u2014 raise family-separation concerns.<\/p>\n<p class=\"p1\">The sharpest edge: some newly recognized Canadians went on to <b>renounce US citizenship<\/b>. Under <span class=\"s3\">INA \u00a7 349(a)(5)<\/span>, renunciation is done in person abroad before a consular officer and takes effect on State Department approval of a Certificate of Loss of Nationality (<span class=\"s3\">INA \u00a7 358<\/span>). It is, for practical purposes, final: <span class=\"s3\">INA \u00a7 351<\/span> sharply limits reversal, and while <span class=\"s3\">22 C.F.R. \u00a7 50.51<\/span> lets State vacate a CLN on narrow discretionary grounds, that is no appeal as of right and cannot be counted on. State&#8217;s own guidance warns that, absent a second nationality, a renunciant &#8220;would become stateless.&#8221;<\/p>\n<p class=\"p1\"><strong>The trap, <span class=\"s2\">plainly<\/span><\/strong><\/p>\n<p class=\"p1\">Someone who renounced US citizenship in reliance on a now-questioned Canadian certificate cannot simply reclaim it. If the Canadian status is stripped, they can be left stateless. So treat any surrender letter as urgent, preserve status through judicial review rather than acquiescing, and counsel <span class=\"s4\"><i>against <\/i><\/span>renouncing any other nationality while a certificate&#8217;s validity is in doubt.<\/p>\n<p class=\"p1\">General information for professional discussion; not legal advice and not a substitute for qualified counsel.
