{"id":2160,"date":"2023-01-25T15:17:02","date_gmt":"2023-01-25T20:17:02","guid":{"rendered":"https:\/\/cila.co\/?p=2160"},"modified":"2024-09-30T16:23:42","modified_gmt":"2024-09-30T20:23:42","slug":"cila-statement-on-waiving-eligibility-criteria-for-temporary-resident-visas","status":"publish","type":"post","link":"https:\/\/cila.co\/fr\/cila-statement-on-waiving-eligibility-criteria-for-temporary-resident-visas\/","title":{"rendered":"CILA Statement on Waiving Eligibility Criteria for Temporary Resident Visas"},"content":{"rendered":"<p>This article was authored by members of the <strong>Canadian Immigration Lawyers Association (CILA)<\/strong><\/p>\n<p><!--more--><\/p>\n<p style=\"font-weight: 400;\">The Canadian Immigration Lawyers Association (CILA) believes that the extraordinary measure of waiving eligibility criteria for temporary resident visas (TRVs) as reported by <em>The Globe &amp; Mail<\/em><a href=\"applewebdata:\/\/36E404F2-C0EF-4DF3-8D37-4055D2C2EC26#_ftn1\" name=\"_ftnref1\">[1]<\/a> is counterproductive to repairing trust in Immigration Refugee Citizenship Canada (IRCC), which is one of the intended goals of this proposed new measure.<\/p>\n<p style=\"font-weight: 400;\">If the criterion for approval is unilaterally waived, this will erode public confidence in the integrity of Canada\u2019s immigration system and rules, not rebuild trust.\u00a0The public will fear a spike in the number of individuals who overstay; work without authorization due to insufficient funds; or make refugee claims. In turn, these outcomes will lead to more immigration applications to Canada and within Canada. This will result in greater IRCC, Immigration Refugee Board, Federal Court and Canadian Border Service Agency (CBSA) resources being spent for years to come.<\/p>\n<p style=\"font-weight: 400;\">One positive indicator is that admissibility checks will not be waived, but this begs the question as to whether or not reduced processing times will be realized.<\/p>\n<p style=\"font-weight: 400;\">Of significant concern is\u00a0the lack of consultation with stakeholders with respect to these proposed changes. Furthermore, the suggestion that the proposed changes in criteria might not have been made public causes CILA to once again demand transparency from IRCC with respect to how applications are being assessed.<\/p>\n<p style=\"font-weight: 400;\">CILA has the following recommendations for IRCC to reduce backlogs:<\/p>\n<ol>\n<li>Require IRCC officers to return to the office to work;<\/li>\n<li>Implement new and better means to communicate with applicants and representatives so that IRCC resources are not unnecessarily wasted on responding to thousands of status inquires; ensure that the responses to applicants and representatives are meaningful to eliminate further inquiries;<\/li>\n<li>Allow applicants with maintained status to travel outside of Canada and temporarily re-deploy IRCC resources from extension applications to processing TRV applications;<\/li>\n<li>When processing in-Canada extension applications for those who also require new TRVs, process these concurrently to\u00a0free up processing resources in Ottawa; reallocate these resources to where they are needed;<\/li>\n<li>Shift the processing of PR Card renewals to passport offices and only refer complicated residence cases to IRCC for evaluation and processing;<\/li>\n<li>Temporarily partner with CBSA to help process TRV-exempt temporary status applications at ports-of-entry to reduce pressures on IRCC.<\/li>\n<\/ol>\n<p><!--more--><\/p>\n<p>&#8212;<\/p>\n<p><!--more--><\/p>\n<p style=\"font-weight: 400;\">L&#8217;Association canadienne des avocats en droit de l&#8217;immigration (ACAI) estime que la mesure extraordinaire visant \u00e0 renoncer aux crit\u00e8res d&#8217;admissibilit\u00e9 dans l\u2019analyse des demandes de visas de r\u00e9sident temporaire (VRT), telle que rapport\u00e9e par <em>The Globe &amp; Mail<\/em>,<a href=\"applewebdata:\/\/36E404F2-C0EF-4DF3-8D37-4055D2C2EC26#_ftn2\" name=\"_ftnref2\">[2]<\/a> va \u00e0 l&#8217;encontre de l&#8217;objectif de r\u00e9tablir la confiance du public enversImmigration, R\u00e9fugi\u00e9s et Citoyennet\u00e9 Canada (IRCC). Le r\u00e9tablissement de la confiance du public est n\u00e9anmoinsl&#8217;un des buts de cette mesure.<\/p>\n<p style=\"font-weight: 400;\">En effet, si certains crit\u00e8res d&#8217;approbation sont unilat\u00e9ralement lev\u00e9s, cela \u00e9rodera la confiance du public \u00e0 l\u2019\u00e9gard de l&#8217;int\u00e9grit\u00e9 du syst\u00e8me et des r\u00e8gles d&#8217;immigration au Canada, plut\u00f4t que r\u00e9tablir cette confiance. Le public craindra une augmentation du nombre de personnes qui resteront ill\u00e9galement au Canada \u00e0 la fin d\u2019un s\u00e9jour temporaire autoris\u00e9e, qui travailleront sans autorisation afin d\u2019assurer leur subsistance ou qui demanderont l\u2019asile au Canada. Ces r\u00e9sultats entra\u00eeneront une augmentation des demandes d&#8217;immigration pour entrer au Canada et pour demeurer \u00e0 l&#8217;int\u00e9rieur du Canada causant une hausse de l\u2019utilisation des ressources d\u2019IRCC, de la Commission de l&#8217;immigration et du statut de r\u00e9fugi\u00e9, de la Cour f\u00e9d\u00e9rale et de l&#8217;Agence des services frontaliers du Canada (ASFC) pour plusieurs ann\u00e9es \u00e0 venir.<\/p>\n<p style=\"font-weight: 400;\">Un aspect positif \u00e0 relever de cette mesure extraordinaire est le maintien des v\u00e9rifications li\u00e9es \u00e0 l\u2019admissibilit\u00e9 au Canada. Or, si ce crit\u00e8re d\u2019analyse est maintenu, est-ce qu\u2019IRCC r\u00e9ussira \u00e0 r\u00e9duire les d\u00e9lais de traitement des demandes?<\/p>\n<p style=\"font-weight: 400;\">L&#8217;absence de consultation des parties prenantes concernant les changements propos\u00e9s nous pr\u00e9occupe. De plus, l\u2019article sugg\u00e8re que cette mesure n\u2019\u00e9tait pas n\u00e9cessairement destin\u00e9e \u00e0 \u00eatre rendue publique. L\u2019ACAI demande encore une fois \u00e0 IRCC de faire preuve de transparence \u00e0 l\u2019\u00e9gard des crit\u00e8res d\u2019\u00e9valuation des demandes.<\/p>\n<p style=\"font-weight: 400;\">L&#8217;ACAI formule les recommandations suivantes \u00e0 IRCC pour r\u00e9duire les arri\u00e9r\u00e9s :<\/p>\n<ol>\n<li>Obliger les agents d&#8217;IRCC \u00e0 retourner travailler au bureau;<\/li>\n<li>Mettre en \u0153uvre de meilleurs moyens de communication entre IRCC et les demandeurs ou leursrepr\u00e9sentants afin d\u2019\u00e9viter que les ressources d&#8217;IRCC gaspillentinutilement leur temps \u00e0 r\u00e9pondre \u00e0 des milliers de demandes de renseignements quant \u00e0 l\u2019\u00e9tat de traitement des demandes d\u2019immigration en traitement. Ces meilleurs outils devraient aussipermettre de s\u2019assurer que les r\u00e9ponses transmises par IRCC aux demandeurs et \u00e0 leurs repr\u00e9sentants soient pertinentes afin d\u2019\u00e9viter la transmission subs\u00e9quente de demandes d\u2019information \u00e0 IRCC;<\/li>\n<li>Permettre aux r\u00e9sidents temporaires b\u00e9n\u00e9ficiant d\u2019un statut conserv\u00e9 de voyager \u00e0 l&#8217;ext\u00e9rieur du Canada et de revenir au Canada.
